1. Agreement to These Terms

By creating an account or using The Learning Wheel platform ("the Platform," "we," "us"), you ("the Administrator," "Parent," or "User") agree to these Terms of Service and Privacy Policy in full. If you do not agree, do not create an account or use the Platform.

These Terms govern all use of the Platform, including the school management dashboard, student activity tools, community board, and all related services.

2. Description of Service

The Learning Wheel is a private, invitation-only platform designed to support Alaska-based homeschool families. It provides:

• A digital school management environment for parents and children
• Student activity tracking, goal setting, and educational tools
• AI-assisted academic placement assessments
• An optional inter-school community board for participating families

Access requires an invite code issued by a Platform administrator. The Platform is not a public service and is not affiliated with any Alaska state agency or school district.

3. Eligibility & Account Responsibility

You must be at least 18 years of age to create a school account. By registering, you represent that:

• You are the parent or legal guardian of the students associated with your account
• All information you provide is accurate and complete
• You will keep your credentials (password, PIN, family access code) confidential and secure
• You accept full responsibility for all activity that occurs under your account

You are responsible for ensuring that your use of the Platform complies with all applicable laws, including Alaska homeschool statutes (AS 14.30.010).

4. Student Privacy & FERPA

The Learning Wheel is designed in compliance with the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g. As the parent and school administrator:

• You retain full control of your children's education records stored on the Platform
• Student data is stored in an isolated school environment accessible only to your family
• AI-generated assessment reports are stored within your school account and are not shared externally
• You may request deletion of all school data at any time by contacting us

The Platform does not sell, rent, or share student education records with any third party, advertiser, or other school without explicit written consent from the account holder.

5. Community Board

Participation in the inter-school community board is entirely optional and must be explicitly enabled by the school administrator.

When the community board is enabled:

• Your school's name and icon will be visible to other opted-in schools
• Messages you post are visible to all participating schools
• No student data, names, grades, or education records are included in community board posts or the school directory
• You are solely responsible for the content you post

You agree not to post content that is unlawful, harassing, defamatory, or contains personal information about minors. The Platform reserves the right to remove any post and revoke community access for violations.

6. AI Features & Assessments

The Platform uses third-party AI services (Anthropic Claude) to power assessment and educational tools. By using AI features, you acknowledge:

• AI-generated content (assessments, reports, suggestions) is for informational and planning purposes only and does not constitute official educational or legal advice
• Assessment conversations and reports are stored within your isolated school account
• You supply your own Anthropic API key; the Platform does not retain it beyond your account configuration
• AI outputs may contain errors and should be reviewed by a qualified educator before use in official records

7. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable local, state, or federal law or regulation
• Post or transmit content that is abusive, threatening, or harmful to minors
• Attempt to gain unauthorized access to other accounts or school data
• Interfere with or disrupt the Platform's infrastructure
• Use automated tools to scrape or collect data from the Platform

Violations may result in immediate account suspension or termination.

8. Data Storage & Security

Your school's data is stored on servers located in the United States. We implement reasonable technical safeguards to protect your data, including encrypted connections (HTTPS) and isolated per-school data storage.

However, no system is completely secure. You use the Platform at your own risk and should maintain your own backups of important records.

We retain your data for as long as your school account is active. You may request deletion of your account and all associated data by contacting us at admin@learningwheel.academy.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or meet your specific requirements.

To the maximum extent permitted by law, The Learning Wheel and its administrators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify account holders via the email address associated with their account.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Alaska, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the State of Alaska.
